These Terms of Service ("Terms") govern your access to and use of the Optmazon platform ("Service") operated by Bestor AI LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Optmazon is an Amazon advertising intelligence platform that provides data analysis, optimization recommendations, and automated management tools for Amazon Seller Central and Amazon Advertising accounts. The Service integrates with Amazon's Selling Partner API (SP-API) and Amazon Advertising API to access and analyze your account data.

The Service is designed to help Amazon sellers and agencies optimize their advertising campaigns, keyword strategies, pricing decisions, and listing performance through AI-powered analysis and automation.

2. Account Registration and Eligibility

To use Optmazon, you must:

• Be at least 18 years of age
• Have an active Amazon Seller Central and/or Amazon Advertising account
• Be authorized to grant API access to the Amazon accounts you connect
• Provide accurate and complete registration information
• Maintain the security of your account credentials

Access to Optmazon is currently invite-only. We reserve the right to accept or decline registration at our sole discretion.

3. Amazon API Integration

By connecting your Amazon accounts to Optmazon, you acknowledge and agree that:

• You are authorizing Optmazon to access your Amazon seller and advertising data through Amazon's official APIs
• We access data solely for the purpose of providing optimization recommendations and automated campaign management
• We comply with Amazon's Selling Partner API and Advertising API terms and acceptable use policies
• We do not collect, store, or process any buyer personally identifiable information
• You may revoke API access at any time through your Amazon Seller Central or Advertising Console settings

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of Amazon's terms of service
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Share your account credentials with unauthorized parties
• Interfere with the security or integrity of the Service
• Use the Service to collect or store buyer personally identifiable information
• Resell, redistribute, or sublicense access to the Service without our written consent

5. Intellectual Property

The Service, including its algorithms, software, design, and documentation, is the intellectual property of Bestor AI LLC. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your active subscription.

You retain ownership of your Amazon account data. By using the Service, you grant us a limited license to process your data solely for the purpose of providing optimization services.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

• The Service will improve your Amazon sales or advertising performance
• Optimization recommendations will be accurate or complete
• The Service will be uninterrupted, error-free, or secure
• Any particular results will be achieved from using the Service

7. Limitation of Liability

To the maximum extent permitted by law, Bestor AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or relating to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Bestor AI LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

9. Termination

Either party may terminate the agreement at any time. We reserve the right to suspend or terminate your access to the Service immediately if you violate these Terms. Upon termination, we will delete your data in accordance with our Privacy Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought in the state or federal courts located in Colorado.

11. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after modifications constitutes acceptance of the updated Terms.
